Collection of your Personal Information
In order to better provide you with products and services offered, TierOne may collect personally identifiable information, such as your:
- First and Last Name
- Mailing Address
- Business Name
- E-mail Address
- Phone Number
If you purchase TierOne’s products and services, we collect billing and credit card information. This information is used to complete the purchase transaction.
We do not collect any personal information unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services. If you fill out the “contact” form on this website, we will ask you to provide some personal information (such as email address, name, phone number, and state). We only require that you provide an e-mail address on the contact form. Further, if chat is available through this site, you may be asked to provide information if you participate in an online chat. Please do not submit any confidential, proprietary or sensitive personally identifiable information (e.g. Social Security Number; date of birth; driver's license number; or credit card, bank account, or other financial information) (collectively, "Sensitive Information"). If you submit any Sensitive Information, you do so at your own risk and we will not be liable to you or responsible for consequences of your submission.
Information that you provide to us through the contact form or an online chat will be used so that we may respond to your inquiry. We may also use information you provide to us to communicate with you in the future. If you do not wish to receive such communications, you may opt out (unsubscribe) as described below.
Other ways we collect information may include (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services. We may use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.
Use of your Personal Information
TierOne collects and uses your personal information to operate and elicit the services you have requested. We may also use your personally identifiable information to inform you of other products or services available from TierOne and its affiliates.
Automatically Collected Information
TierOne strives to provide the best experience for our Web users. To that end, Information about your computer hardware and software may be automatically collected by us. When you visit our website, we may track information about your visit and store that information in web server logs, which are records of the activities on our sites. The servers automatically capture and save the information electronically.
Examples of the information we may collect include:
- your unique Internet protocol address;
- the name of your unique Internet service provider;
- the town/city, county/state and country from which you access our website;
- the kind of browser or computer you use;
- the number of links you click within the site;
- the date and time of your visit;
- the web page from which you arrived to our site;
- the pages you viewed on the site;

- certain searches/queries that you conducted via our website(s) and/or search terms used to come to the site.
The information we collect in web server logs helps us administer the site, analyze its usage, protect the website and its content from inappropriate use and improve the user's experience. We collect information from the users who read, browse, and/or download information from TierOne.
Information Collected for Tracking and Customization (Cookies)
One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize TierOne pages, or register with the site or services, a cookie helps us to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing address, shipping address, and so on. When you return to the same website, the information you previously provided can be retrieved, so you can easily use the features you customized.
You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the TierOne services or websites you visit. TierOne may use three types of information collecting tools on its various Web sites: session cookies, persistent cookies, and other customization tools.
Session cookies do not contain personal information, and once you close your browser, the cookies disappear. TierOne uses session cookies on our site for technical purposes such as to enable you to more easily navigate throughout the TierOne Web site. Session cookies only collect non-personally identifiable data.
Persistent cookies store information on your computer for longer periods of time. TierOne may use persistent cookies to improve and customize your online experience and remember you between visits. Persistent cookies can “remember” user preferences that you voluntarily provide and can create a more seamless experience.
Customization tools allow you to voluntarily provide information to personalize and improve your online experience on a particular Web site.

Security of your Personal Information
TierOne secures your personal information from unauthorized access, use, or disclosure. We use the following methods for this purpose:
- SSL Protocol
When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.
We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the internet which are beyond our control: and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed.
Right to Deletion
Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:
- Delete your personal information from our records; and
- Direct any service providers to delete your personal information from their records.
Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:
-Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
-Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
-Debug to identify and repair errors that impair existing intended functionality; Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
-Comply with the California Electronic Communications Privacy Act;
-Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
-Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
-Comply with an existing legal obligation; or
-Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
Sharing information with Third Parties
TierOne does not sell, rent or lease its customer lists to third parties.
We may share data with trusted partners, such as Google Analytics, to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to TierOne, and they are required to maintain confidentiality of your information.
TierOne may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to conform to the edicts of the law or comply with legal process served on TierOne or the site; (b) protect and defend the rights or property of TierOne; and/or (c) act under exigent circumstances to protect the personal safety of users of TierOne, or the public.
“Do Not Track” Signals under California Online Protection Act (CalOPPA)
Our web services do not alter, change, or respond upon receiving Do Not Track (DNT) requests or signals in browsers. As described in more detail above, we track user activity using web server logs, cookies, and similar technologies. Information collected in web server logs helps us analyze website usage and improve the user's experience. Cookies allow us to offer you a customized experience and present relevant advertising to you.
Customer Proprietary Network Information (CPNI)
Certain of the information that we collect from you may constitute Customer Proprietary Network Information, or CPNI. CPNI is certain information that we obtain solely by virtue of providing you with VoIP Services, and that concerns the VoIP Services you purchase, including the type, destination, technical configuration, location and amount of use of such Services, along with related billing information.
From time to time, we will use the CPNI information we have on file to provide you with information about our communications-related products and services or special promotions. Our use of CPNI may also enhance our ability to offer products and services tailored to your specific needs. We may use your CPNI to let you know about communications-related services other than those to which you currently subscribe that we believe may be of interest to you. In some instances, we will want to share your CPNI with our independent contractors, suppliers, vendors, or agents in order to provide you with information about our communications-related products and services or special promotions. Your signature on a service agreement or sales order signifies your consent that we may use and disclose CPNI as described herein.
Nonetheless, you do have the right to restrict our use of your CPNI as described above. You may deny, withdraw or restrict our right to use CPNI at any time by advising us via email message to email@example.com. If you deny or restrict approval for us to use your CPNI, you will suffer no effect, now or in the future, with regard to how we provide any Services to which you subscribe. Any denial or restriction of your approval remains valid until your Services are discontinued or you affirmatively revoke or limit such approval or denial.
We may disclose CPNI without your consent, and without asking for or receiving your authorization, in any of the following circumstances:
• When disclosure is required by law or court order.
• To protect our rights and property or to protect us, you, and other carriers from fraudulent, abusive, or unlawful use of services.
• For directory listings.
• To provide Services to you, including assisting you with troubles associated with the Services. Without limiting the foregoing, if you purchased your Services through a reseller of our Services, that entity may provide you with certain support services, and we and such reseller will share your CPNI as necessary to provide you with customer support.
• To bill you for Services.
Federal privacy rules require us to authenticate the identity of the Customer calling us prior to disclosing CPNI. Customers calling us can discuss their Services and billings with a TierOne representative once that representative has verified the caller’s identity. There are three methods by which we will conduct Customer authentication:
1. By having the Customer provide a pre-established password and/or PIN;
2. By calling the Customer back at the telephone number associated with the Services purchased; or
3. By mailing the requested documents to the Customer’s address or email address of record.
In the event the Customer fails to remember their password and/or PIN, the representative will ask the Customer a series of questions known only to the Customer and TierOne in order to authenticate the Customer. You may manage your password by contacting us (see below) or as instructed when your Service is installed.
TierOne will notify you of changes to your account. These notifications may be sent to a postal or e-mail address, or by telephone, voicemail, or text message.
In the event TierOne experiences a privacy breach and CPNI is disclosed to unauthorized persons, TierOne will notify law enforcement as required by Federal regulations. TierOne cannot inform Customer of the CPNI breach until at least seven (7) days after notification has been sent to law enforcement, or later if law enforcement directs us to postpone disclosure pending investigation. TierOne is required to maintain certain records regarding any breach involving the release of CPNI, and retain these records for a period of not less than two (2) years.
Legal Basis for Processing Personal Data under the General Data Protection Regulation (GDPR)
• We need to perform a contract with you
• You have given us permission to do so
• The processing is in our legitimate interests and it is not overridden by your rights
• For payment processing purposes
• To comply with the law
Our Service does not address or target anyone under the age of 18 (“Children”).
We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from Children without verification of parental consent, we take steps to remove that information from our servers.
From time to time, TierOne may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from TierOne or click on a link therein.
If you would like to stop receiving marketing or promotional communications via email from TierOne, you may opt out of such communications by replying UNSUBSCRIBE to firstname.lastname@example.org or by clicking the UNSUBSCRIBE button in the email.
Security of Information
For site security purposes and to ensure that this service remains available to all users, TierOne computer systems employ software to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. If such monitoring reveals evidence of possible abuse or criminal activity, such evidence may be provided to appropriate law enforcement officials. Unauthorized attempts to upload or change information on this server are strictly prohibited and may be punishable under the Computer Fraud and Abuse Act of 1986 and the National Information Infrastructure Protection Act or other law.
We may store your data on servers provided by third party hosting vendors with whom we have contracted.
